Is Sun Glare a Good Enough Reason to Hit a Pedestrian? No.

A New York City taxi driver struck and seriously injured a pedestrian yesterday in Soho.  The driver, Kah-Am Rahaman, was quoted as saying when he turned his cab, the glare from the sun blinded him and he struck a pedestrian who was crossing the street.  

This avoidable accident happened at the corner of Spring Street and Crosby Street.  The 30 year old pedestrian was seriously injured and was taken to Bellevue Hospital via ambulance.

Under New York law, sun glare is not a defense to causing an accident, regardless of whether the accident involves a pedestrian, bicyclist or another vehicle.  A driver must reasonably operate their vehicle under all conditions and circumstances, including sun glare.  A driver must use caution when turning, regardless if the driver knew sun glare could be right around the corner.
