Staten Island Man, James Benedict, Dies After Drunk Driver, Michael Pogorzelski, Hits Him on Lily Pond Avenue

A man died in front of his nephews Sunday night when a drunk driver slammed into him with his SUV.

James Benedict, 67, was walking with some nephews in a bicycle lane on Lily Pond Avenue when a 2004 Lexus SUV hit him from behind about 6:55 p.m. near Guilford Street.

Benedict was rushed to Staten Island University Hospital and pronounced dead.

The driver, 39-year-old Michael Pogorzelski, was taken into custody at the scene and faced charges of driving while intoxicated.

One of the main jobs of a good law firm is to determine how many insurance policies may be responsible for compensating a family in a wrongful death case. We would investigate if the drunk driver was driving someone else's car, and if so, whether the owner was negligent in lending their vehicle to an unlicensed driver.  We would also look into whether the drunk driver was working at the time of the accident and whether his employer would be liable.  It is also against the law for a bar to serve alcohol to a person who is visibly intoxicated.  Under the New York State Dram Shop law, the bar owner is responsible for any accident caused by a drunk driver.
