Rooftop at 434 West 33rd Street Where Worker Fell Lacked Guardrails

A building where a construction worker fell to his death Monday violated city safety regulations by failing to install guardrails, according to online records.

The worker fell from the top of the 10-story office building at 434 W. 33rd St, landing on scaffolding above the sidewalk.

The man died from the impact and another man who was traumatized by the incident was taken to Bellevue Hospital. Officials have yet to identify the deceased worker.

According to Department of Buildings records, the building, which houses Planned Parenthood offices among others, was in the middle of a $442,094 facade renovation that included work on its rooftop skylights.

Calls to the building's property manager, Newark Grubb Knight Frank, were not returned. Howard L. Zimmerman Architects, which filed permits for the renovation, did not respond to requests for comment.

As of Tuesday afternoon, a stop work order remained on the property, though workers were on the scaffolding surrounding the building.

According to the order, in addition to the lack of guardrails, there was also unsafe storage of materials on the roof.

The DOB did not respond to a request for information about fines.

Previously, the building was fined thousands of dollars on several occasions since 2010 for illegal advertising, including a $25,000 fine in September for a Sparkling Ice ad.

The New York Labor law is in place to protect workers from this exact type of accident.  However, owners of properties and general contractors continue to fail to make sure workers are given proper fall protection devices.  Hiring the right lawyer is very important to obtain all of the possible benefits and compensation available in a construction site fall case.
